These Terms & Conditions (“Terms”) govern your access to and use of the Grace Flow Connect website, dashboard, and related communication services (collectively, the “Services”) provided by Grace Flow Connect (“Grace Flow Connect,” “we,” “us,” or “our”). By accessing the Services, creating an account, or opting in to receive text messages, you agree to be bound by these Terms.

1.Acceptance of Terms

By accessing or using the Services, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy. If you do not agree, you must not use the Services.

If you use the Services on behalf of a church, ministry, or other organization (an “Organization”), you represent that you are authorized to bind that Organization to these Terms.

2.Description of the Service

Grace Flow Connect is a church engagement and follow-up platform that helps churches and ministries stay connected with visitors and members. Features may include visitor follow-up, prayer request management, pastoral care tracking, events and volunteer management, reporting, and communications via SMS text message and email.

The Services are intended for use by church staff, ministry leaders, volunteers, and the members and visitors who choose to connect with a participating Organization.

3.Eligibility & Accounts

  • You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account or provide consent to receive messages.
  • You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
  • You agree to provide accurate, current, and complete information and to keep it updated.
  • You must notify us promptly of any unauthorized use of your account.

4.SMS / Text Messaging Program Terms

The following terms apply to our SMS/text messaging program, which is powered by Twilio. By providing your mobile number and opting in, you agree to these messaging terms.

Program Description

When you opt in, Grace Flow Connect (on behalf of a participating Organization) may send recurring automated promotional and personalized text messages, such as welcome messages, event reminders, church updates, prayer follow-ups, and pastoral care communications.

Consent & Opt-In

You opt in by submitting your mobile number and affirmatively checking the SMS consent checkbox on our website or a participating Organization’s form, or by texting a designated keyword to our number. Consent to receive text messages is not a condition of membership, attendance, or any purchase. Message consent is not shared with third parties or affiliates for their own marketing purposes.

Message Frequency

Message frequency varies based on your interaction with a participating Organization and the programs you opt in to.

Message & Data Rates

Message and data rates may apply. Check with your wireless carrier for details about your messaging plan. Grace Flow Connect is not responsible for any charges from your wireless carrier.

Opt-Out (STOP)

You may cancel the SMS service at any time by replying STOP to any message. After you send STOP, we will send a one-time confirmation message and you will no longer receive SMS messages from that program. To rejoin, simply opt in again.

Supported Carriers

Carriers are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission by your wireless carrier and is not guaranteed.

For details on how we handle the information you provide in connection with text messaging, please review our Privacy Policy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.

5.Organization Responsibilities

If you are an Organization using the dashboard to communicate with your contacts, you are solely responsible for the messages you send and for complying with all applicable laws, including the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, CTIA guidelines, and carrier requirements.

  • You must obtain proper, documented opt-in consent from each recipient before sending SMS or email messages.
  • You must honor opt-out (STOP) and help (HELP) requests and not message individuals who have opted out.
  • You must not send prohibited content, including messages related to illegal activity, hate, harassment, or content prohibited by carriers (e.g., the regulated “SHAFT” categories).
  • You must keep your contact lists accurate and only message people who have a relationship with your Organization and have consented.

6.Acceptable Use

You agree not to misuse the Services. Prohibited activities include, but are not limited to:

  • Using the Services to send spam, unsolicited messages, or messages to recipients who have not consented;
  • Violating any applicable law, regulation, or third-party right;
  • Attempting to gain unauthorized access to the Services or related systems;
  • Interfering with or disrupting the integrity or performance of the Services;
  • Uploading malicious code or attempting to compromise data security.

7.Intellectual Property

The Services, including all software, design, text, graphics, and trademarks, are owned by Grace Flow Connect or its licensors and are protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Services in accordance with these Terms. Content you submit remains yours, but you grant us a license to host and process it solely to provide the Services.

8.Third-Party Services

The Services rely on third-party providers, including Twilio for SMS messaging and email delivery. Your use of features powered by these providers may also be subject to their terms. We are not responsible for the acts or omissions of third-party providers.

9.Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Services will be uninterrupted, secure, or error-free, or that messages will be delivered without delay or failure.

10.Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GRACE FLOW CONNECT AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES. Our total liability for any claim shall not exceed the amount you paid us, if any, in the twelve months preceding the claim.

11.Indemnification

You agree to indemnify and hold harmless Grace Flow Connect from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your use of the Services, your messages, or your violation of these Terms or applicable law.

12.Termination

We may suspend or terminate your access to the Services at any time if you violate these Terms or to comply with legal or carrier requirements. You may stop using the Services at any time. Sections that by their nature should survive termination will survive.

13.Changes to These Terms

We may update these Terms from time to time. We will post the updated version with a revised “Last updated” date. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.

14.Governing Law

These Terms are governed by the laws of [State/Country], without regard to its conflict-of-laws principles. Any disputes shall be resolved in the courts located in [Jurisdiction].
